SC says 2017 ruling on Las Piñas land final

The Supreme Court has declared with finality its 2017 decision that nullified the 1992 land titles issued in favor of Ayala Land Inc. over 135,000 square meters of land in Las Piñas City due to defective land surveys and technical descriptions presented to the trial court for land titling.

In a resolution dated April 10 but was made public only last June 4, the SC turned down the second motion for consideration filed by ALI seeking a reversal of the July 26, 2017 decision and December 4, 2017 resolution that denied the first motion for reconsideration.

In its 2017 decision, the SC upheld the land titles issued to spouses Yu Hwa Ping and Mary Gaw and spouses Andres and Josefa Mia Diaz.

The high court overturned the 2006 decision of the Court of Appeals in favor of ALI, which obtained its land titles from the purchase of the property from CPJ Corporation in 1992.

The disputed property had been converted into a golf course and materials depot of Ayala Corp’s Makati Development Corp.

ALI would have wanted the SC en banc to resolve its second motion for reconsideration, but the tribunal said “the SC, sitting en banc, is not an appellate court vis-a-vis its Divisions, and it exercises no appellate jurisdiction over the latter.”
